MANDAN, N.D. (AP) — Morton County commissioners' decision to allow a feedlot with up to 10,000 cattle northwest of Mandan is being appealed to the state Supreme Court.
The attorney for Donald and Mark Hagerott says the feedlot would be within a quarter-mile of where the county gave the Hagerotts a permit to build a house. Attorney Tami Norgard says the Hagerotts' housing permit preceded the feedlot permit.
South Central District Judge Bruce Haskell upheld the county commissioners' decision on the feedlot in December.
Fred Berger wants to put the feedlot on a 137-acre site about 15 miles northwest of Mandan. He could not be reached for comment.
County officials say Berger's brother, Chad, is building a smaller feedlot on a former dairy farm just south of Mandan, to keep up to 650 yearlings and rodeo stock.
